In August, 2002, we filed a
class action and Business and Professions Code section 17200
representative action against Sam's Club on behalf of all Meat Managers.
In October 2002, Frank Coughlin of the law firm of Coughlin & Conforti
filed a similar action on behalf of Sam's Club Bakery Managers.

The parties agreed that the two cases would be consolidated and tried as
a single case. The parties then submitted the case to private
mediation. At the mediation, the parties agreed to settle the case
on behalf of Sam's Club Meat Managers, Bakery Mangers and Area Receiving
Managers. The Class Members received substantial payments
for unpaid overtime, waiting-time penalties and interest.
