This case was settled after 4½
years of litigation and a lengthy private mediation held on November
7, 2005. On April 17, 2006, the Superior Court entered an order
granting preliminary approval to the settlement and to the settlement
documents. The settlement is being administered by Rosenthal & Co. in
Novato, California.

Forms must be postmarked on or before May 30,
2006 or personally delivered to the Claims
Administrator by no later than June 5, 2006.

Fairness and Final Approval Hearing is
scheduled for 9:00 a.m. on July 10, 2006
in Department R12 of the Superior Court located at
8303 Haven Avenue, Rancho Cucamonga, California.
